I'm no familiar with Vermeule, but it seems from what I read here that his idea of "higher good" would run afoul of the establishment clause. I do think the court would be hypocritical enough to allow a federal ban on abortion, but again I think a suit based on the establishment clause could win. I guess we'll see.
It absolutely would, but if you familiarize yourself with Vermeule (and I'm not sure that's a great idea from a mental health standpoint), you'll quickly find that he doesn't really give a damn about violating the Establishment Clause or cares much for the Liberal constitutional order that we (I assume) value.
Yeah, most of the people who defend ideas based on Christianity don't give a darn about religious freedom, but are very much in favor of religious privilege for christianity.
